DISTANCE SALES AGREEMENT ("Agreement")


This Distance Sales Agreement is drafted in compliance with the Regulation on Distance Contracts published in the Official Gazette dated November 27, 2014, numbered 29188, and takes this regulation as its reference.

  1. PARTIES

This Distance Sales Agreement ("Agreement") is electronically executed between the buyer ("BUYER") whose address is specified in Article 6, and NANU KOZMETİK GÜZELLİK SANAYİ TİCARET LİMİTED ŞİRKETİ ("SELLER") located at İstiklal Mh. Alemdağ Cd. Kaptan İş Merkezi, Apt. No: 7, Suite No: 244, 34762 Ümraniye, Istanbul, under the terms and conditions detailed below.

  1. DEFINITIONS

In the implementation and interpretation of this Agreement, the following terms shall have the meanings written opposite them:

  1. SUBJECT

This Agreement is drafted according to Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts. Parties declare that they understand and accept their obligations and responsibilities arising from this law and regulation. The subject of this Agreement is to define the rights and obligations of the parties regarding the sale and delivery of the product(s) ordered electronically by the BUYER from the SELLER’s website, details and total price including taxes stated below. Listed prices are valid until updated. Promotional prices are valid until the specified date and are limited to stocks.

  1. GENERAL PROVISIONS

9.1. BUYER acknowledges having read and understood product details, prices, payment, and delivery terms. 9.2. Products will be delivered within the period stated on the website, not exceeding 30 days. 9.3. SELLER undertakes to deliver products complete, defect-free, and compliant with the agreement. 9.4. SELLER may provide an equivalent product after notifying and obtaining approval from the BUYER. 9.5. SELLER’s delivery obligation ceases if payment is not completed. 9.6. BUYER agrees to return the product within 3 days if unauthorized payment occurs. 9.7. SELLER will notify BUYER of force majeure circumstances. 9.8. BUYER must inspect products upon delivery and reject damaged goods. 9.9. SELLER can request verification if suspicious activities occur regarding payment. 9.10. BUYER agrees to provide accurate personal data and indemnify damages caused by misinformation. 9.11. BUYER must comply with applicable laws when using the website. 9.12. Website misuse causing harm is prohibited. 9.13. SELLER is not responsible for third-party websites. 9.14. BUYER indemnifies SELLER against legal or penal consequences of breaches.

  1. PERSONAL DATA PROTECTION AND ELECTRONIC COMMUNICATION PERMISSION

Detailed terms on personal data handling, rights, data storage duration, sharing with authorities, and electronic communication permissions according to KVKK (Personal Data Protection Law) and related regulations.

  1. RIGHT OF WITHDRAWAL

BUYER may withdraw from the contract without justification within 14 days from product delivery, abiding by specified conditions for returns.

  1. EXCEPTIONS TO RIGHT OF WITHDRAWAL

Conditions under which the right of withdrawal cannot be exercised.

  1. DISPUTE RESOLUTION

Consumer Arbitration Committees and Consumer Courts are authorized for disputes according to the specified monetary limits.

  1. DEFAULT AND LEGAL CONSEQUENCES

Conditions regarding BUYER’s obligations in case of default on payments made via credit card.

  1. EVIDENCE AGREEMENT AND JURISDICTION

SELLER's records constitute definitive evidence. The parties accept the jurisdiction of Consumer Arbitration Committees and Courts in their respective domiciles.

  1. LIABILITY FOR DAMAGES

SELLER is responsible for product damage until delivery to BUYER or their representative.

  1. EFFECTIVENESS

Upon payment confirmation, BUYER agrees to all terms herein. SELLER ensures technical compliance to prevent orders without explicit agreement consent.
